The rules that apply when you use this website or send an enquiry through it.

Agreeing to these terms

These terms apply to kiamatreeremoval.com.au. By using the site, submitting the enquiry form or ringing the number published on it, you accept them. If you do not accept them, please do not use the site.

They are written to be read, not to be impenetrable. If something here is unclear, ring (02) 4214 4543 and ask.

1. What this website does

Kiama Tree Removal is a referral website. Its function is to take enquiries from people in the Kiama Municipality and surrounding areas and pass them to independent tree contractors who work locally.

The operator of this website does not climb trees, does not operate machinery, does not attend your property and does not perform tree work of any kind. All of that is done by third-party contractors running their own businesses. The Disclaimer sets this out in detail and forms part of these terms.

2. Enquiries are not bookings

Sending the form or leaving a message starts a conversation. It does not create a contract with anyone, and it does not lock in a date, a price or a crew.

A job only exists once a contractor has inspected or discussed the work with you and you have both agreed on scope and price. That agreement is between you and the contractor. The operator of this website is not a party to it.

3. Quotes, prices and timing

Nothing on this site is a quote. No price is published here, and none is implied.

Prices are set by the contractor after they have looked at the specifics — the tree, the access, what sits underneath it and how the debris gets out. Two similar-looking trees on adjoining streets in Kiama Downs can be very different jobs.

Availability, response times and scheduling are the contractor's, not ours. We describe the service as open 7 days, 6am–7pm and note that urgent jobs are prioritised. That is a description of how enquiries are handled, not a guaranteed attendance time.

4. Your responsibilities

When you use this site, you agree to:

  • give accurate information about yourself and the job;
  • only submit an enquiry for a property you own, occupy or are authorised to arrange work on;
  • satisfy yourself about any contractor before letting them start — including asking to see their public liability insurance certificate and their qualifications for the work;
  • confirm with Kiama Council whether the tree work you want requires approval, before it happens; and
  • not use the site for anything unlawful, abusive, or intended to damage or disrupt it.

5. Approvals are your responsibility

Tree work on private land in the Kiama Municipality is regulated by Council. Removing or pruning a protected tree without approval can attract penalties.

Information on this site about Council rules is general and may be out of date. It is not an approval, and it is not confirmation that you do not need one. Confirm your specific tree with Kiama Council on 02 4232 0444 before work is booked. Where this site and Council disagree, Council is correct.

6. Content on this site

All text, layout, graphics and design on kiamatreeremoval.com.au are protected by copyright and remain the property of the website operator or its licensors.

You are welcome to read it, print it and link to it. You may not copy, republish, scrape or reproduce substantial parts of it for commercial purposes without written permission.

Information about tree species, coastal conditions, storm behaviour and Council processes is general information for the district. It is not arboricultural, legal or engineering advice about your particular tree. Get a qualified arborist to inspect anything you are worried about.

Where we link out — to Kiama Council, NSW government pages, or other resources — we do it because the information is useful. We do not control those sites and are not responsible for their content, accuracy or availability.

8. Availability of the website

We aim to keep the site up and accurate, but we do not promise it will be available without interruption, free of errors, or free of anything harmful. Content may be changed, corrected or removed at any time without notice.

9. Limitation of liability

To the maximum extent permitted by law, the operator of this website is not liable for any loss, damage, cost, injury or expense arising from:

  • your use of, or inability to use, this website;
  • reliance on any general information published here;
  • the acts, omissions, workmanship, pricing, timing or conduct of any independent contractor; or
  • any dispute between you and a contractor you were introduced to.

Nothing in these terms excludes, restricts or modifies any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law. Where liability can be limited rather than excluded, it is limited to resupplying the relevant service or paying the cost of having it resupplied.

10. Referral arrangements

The operator of this website may receive a fee or other commercial benefit from contractors in connection with enquiries referred to them. This does not increase the price you are quoted, and it does not oblige you to use any contractor you are introduced to. Getting a second quote is always sensible.

11. Privacy

How your information is collected, used and shared is covered in the Privacy Policy.

12. Changes to these terms

We may update these terms. The version published on this page is the one that applies, from the date shown above.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and any dispute is subject to the jurisdiction of the courts of that State.
